Terms of Service for Pacific Flight Academy LLC

Welcome to Pacific Flight Academy LLC ("PFA," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website (https://www.pacificflightacademy.com), services, and facilities, including flight training, discovery flights, FAA PSI testing, and related programs at our Honolulu, HI location (14 Lagoon Dr., Honolulu, HI 96819). By accessing our website, enrolling in training, booking services, or using our facilities, you agree to these Terms. If you do not agree, please do not use our services.

1. Services Provided

PFA offers:

  • Flight Training: Private, commercial, instrument, CFI, and multi-engine training under FAA Part 61, including the Horizon Air Pilot Development Program (PDP).

  • Discovery Flights: 45-minute introductory flights in our Sling 2 NGT or Cessna 172 aircraft.

  • FAA PSI Testing: Airman Knowledge Tests for pilot, mechanic, and drone certifications.

  • Facility Use: Access to our training center at Daniel K. Inouye International Airport (HNL) for enrolled students and renters.

All services are subject to FAA regulations, TSA requirements, and PFA policies (e.g., dispatch, checkout forms).

2. Eligibility and Registration

To use our services:

  • Age: Minimum 12 for discovery flights (parental consent required for minors); 14-23 for specific FAA tests (per FAA Airman Knowledge Testing Matrix).

  • TSA Compliance: Non-U.S. citizens must complete TSA clearance via https://www.fts.tsa.dhs.gov/home, provide passport/visa, and a second government ID. TSA approval and a hangar photo must be uploaded to Flight Schedule Pro (FSP) on Day 1.

  • Documentation: Submit signed Membership Agreement, valid ID (passport or driver’s license), and other forms listed at /documents. Incomplete forms will be returned.

  • Health: Meet FAA medical certificate requirements for training (e.g., Class 3 Medical for private pilot).

Failure to comply may result in service denial without refund.

3. Booking and Payments

  • Scheduling: Book discovery flights, training, or tests via our scheduling platform (Flight Schedule Pro) or contact fly@pacificflightacademy.com.

  • Payments: Deposits for discovery flights ($250, subject to change) or training apply toward services; balance billed post-service via our secured processor.. Visiting pilots must provide payment details upfront.

  • Cancellations/Refunds: Cancel/reschedule up to 24 hours prior for full refund (within one year). No-shows or late cancellations forfeit deposits. Weather-related cancellations receive full refunds or rescheduling.

  • Rates: Subject to change; see /rates for current pricing. Hawaii sales tax applies.

4. Safety and Conduct

  • Safety Compliance: Adhere to PFA’s safety protocols, FAA regulations (14 CFR Parts 61, 91), and instructor guidance. Complete required checkouts (e.g., Sling NGT: 5 hours dual training) before solo flights.

  • Conduct: Maintain respectful behavior; no harassment, disruption, or unsafe actions. Violators may be removed from programs without refund.

  • Aircraft Use: Do not operate aircraft without authorization. Damage due to negligence is your responsibility (subject to insurance).

  • Weather: PFA reserves the right to cancel flights for safety (refer to our Dispatch Policy for weather minimums). Students must check weather via FAA-approved sources (e.g., ForeFlight).

5. Intellectual Property

Our website content, logos, checklists (e.g., Sling 2 NGT Checklist V2.2.1), and training materials are owned by PFA or licensed. You may not reproduce, distribute, or modify without permission, except for personal training use (e.g., downloading POHs from /fleet).

6. Liability and Disclaimers

  • Risk Acknowledgment: Flight training and aviation involve inherent risks (e.g., overwater flights, mountainous terrain). You assume these risks upon participation. PFA maintains a zero-incident record (10,000+ hours annually) but is not liable for injuries or damages beyond our control.

  • Insurance: PFA carries aviation liability insurance; renters/students may need additional coverage (check with us).

  • No Warranties: Services are provided "as is." We do not guarantee specific outcomes (e.g., FAA test passage, pilot certification).

7. Termination

We may terminate or suspend your access for:

  • Non-compliance with Terms, FAA/TSA rules, or PFA policies.

  • Non-payment or fraudulent activity.

  • Unsafe or disruptive behavior. Terminated users forfeit deposits; no refunds for incomplete services.

8. Dispute Resolution

  • Governing Law: These Terms are governed by Hawaii law, without regard to conflict of laws.

  • Arbitration: Disputes shall be resolved via binding arbitration in Honolulu, HI, per American Arbitration Association rules. You waive class action rights.

9. Changes to Terms

We may update these Terms; changes are posted at /terms-of-service with the new effective date. Continued use constitutes acceptance. Significant changes will be notified via email or site notice.
